Notwithstanding any damages that You might incur, the entire liability of the Company and any of its suppliers under any provision of this Terms and Your exclusive remedy for all of the foregoing shall be limited to the amount set in out Terms and Conditions of Sale and Purchase. No amount shall be paid to you if no purchase was made through the Service.
To the maximum extent permitted by applicable law, in no event shall the Company or its suppliers be liable for any special, incidental, indirect, or consequential damages whatsoever (including, but not limited to, damages for loss of profits, loss of data or other information, for business interruption, for personal injury, loss of privacy arising out of or in any way related to the use of or inability to use the Service, third-party software and/or third-party hardware used with the Service, or otherwise in connection with any provision of this Terms), even if the Company or any supplier has been advised of the possibility of such damages and even if the remedy fails of its essential purpose.

These Terms and Conditions may have been translated if We have made them available to You on our Service. You agree that the original English text shall prevail in the case of a dispute.

The contents of our website pages are for general information and use only. Any information may change anytime without prior notice.
Website Images
All images in our website are the best representation of our actual products but serves as a guide only. The product colours may appear slightly different in actual due to lighting, angles of shot, screen quality and other factors.
Ordering
ALL SALES ARE FINAL.
Please ensure that you have carefully read the product description and information prior to adding any items to your cart. Should you require more information about the product, feel free to contact us via the “Contact Us” form or by sending us an email. Refunds, returns or exchanges will not be provided due to change of mind or purchase errors.
We try our best to provide the most accurate quantities in our website. However, should an item be out of stock when we go pick your order, the cost will be refunded to you. We will not be putting items on backorder. You are more than welcome to check back our website for availability of items, or you can contact us via email to enquire.
Processing Time
Orders are generally processed/shipped/prepared ready for collection within 1-3 business days but may take longer during busier times.
Express Shipping
Please note that Express Shipping is how Australia Post prioritise your parcel/package once they receive it for delivery. This is not a “RUSH MY ORDER” option.
Order for express shipping will still be processed 1-3 business days.
Shipping
We are shipping out from Aveley, Western Australia 6069 and we only ship within Australia. NO international shipments will be accommodated.
We use Sendle and Australia Post to send your orders and rates of each courier are shown at Checkout. You will choose your preferred courier.
All shipments are processed as “AUTHORITY TO LEAVE” by default. If you wish for your order to be signed upon receipt, kindly choose AUSTRALIA POST from the options, and leave a note (before Checkout) if you require “SIGNATURE ON DELIVERY”. We will send you an invoice for this feature which will also include the applicable merchant’s fee.
Please make sure that the shipping address provided is correct and that you leave an address where someone can receive the package. We will not be NOT LIABLE for any packages left unattended and go missing.
For orders valued more than $100, it is highly recommended that you purchase an EXTRA COVER to cover for potential loss or damage. By default, courier compensation cover for lost or damage is up to $100 only and amount compensated will depend on their discretion. Leave a note (before Checkout) if you require an EXTRA COVER. We will send you an invoice for this feature which will also include the applicable merchant’s fee.
Any item found to be damaged due to transport or lost in transit, the item will be replaced or refunded at our discretion. This may take time as we will need to coordinate with relevant couriers to settle this matter. An investigation will be made, and we will let you of the outcome as soon as we received it. Please take note that we will NOT BE LIABLE for any item/s LOST IN TRANSIT as we use the exact details provided in the order form. Kindly contact Thy Creative Soul within 48 hours (based on Sendle or Australia Post delivery date) of receipt to report the damage/s. Please retain all items and their packaging for investigation purposes. Evidences may be requested from your end.
SHIPPING FEES AT CHECKOUT ARE ESTIMATES ONLY. Purchases over 5kg are calculated by volume and may cost higher than the rates at Checkout. In this case, you may be sent an amended invoice for further shipping costs. Your order/s will only be shipped once the additional costs have been paid in full.
In case of any shipping delays or lost in transit, the courier service will be contacted for investigation.
We are also NOT liable for any item/s delivered late due to courier’s operation. If you need your items urgently, kindly choose EXPRESS POSTAGE at the Checkout.
A refund or replacement will not be processed until the courier’s investigation has been completed.
In case of any missing item/s in your order, kindly notify us within 24 hours of receipt so we can check/ investigate the matter and action accordingly.
Local Pick-up
Local pick-up option is available from Aveley, Western Australia 6069. Kindly select “STORE PICK-UP” from the delivery method when checking out. You will be sent an email when your order is ready for collection. Kindly check your Junk or Spam Folder if you have not received an email within 72 hours. Collection details will be specified in the same email set to you.
Please take note that this option will be by appointment only but several days and times, and/or pick-up options will be provided to accommodate your availability. Please understand that this business is ran alongside work and family.
We ensure that we pick and pack the correct and non-defective/ undamaged item for you. However, we still recommend that you please check your items for defects when collecting locally before leaving our premises. We are unable to offer any REFUND, RETURNS or EXCHANGES for any product/s that have left our premises because of the inability to guarantee on how our product/s were handled, stored or looked after.
Returns, Refunds and Exchanges
Items on SALE or CLEARANCE cannot be returned, refunded, or exchanged unless they do not match the item description when you made the purchase.
Returns
Any item found to be damaged due to transport or lost in transit, the item will be replaced or refunded at our discretion. Kindly contact Pauline Pascual – Weddings & Events within 48 hours (based on Sendle or Australia Post delivery date) of receipt to report the faulty or damaged item/s.
Any returned item must be in its original condition (unused and not personalised).
We do not allow return of items due to change of mind.
If the item/s have left our facility (via postage or pick-up), we will not allow a refund or exchange of the item/s.
If the item/s have not left our facility, a restocking fee of 15% will be applied. A new invoice will be sent to you. We will only process the request once invoice is paid.
Refunds
We DO NOT offer refunds for change of mind or purchase errors.
We DO NOT offer refunds for items damaged due to customer’s error.
We DO NOT offer refunds for items lost in transit (as declared by the courier).
We DO NOT offer refunds for items on SALE or CLEARANCE unless they do not match the item description when you made the purchase.
In case of any refunds, you will be charged a 15% fee to cover the applicable merchant fees and admin fee. This includes partial refunds and changes from shipping to local pick-up.

Event Hire and Services
*Terms and Conditions for EVENT HIRE and SERVICES are provided separately once an agreement had been made between You and the Company.
